The National Water Act (NWA) of South Africa regulates the country’s water resources to ensure sustainable usage. A key component of this legislation is Section 21, which outlines various water uses that require licensing. For residents and businesses in the Garden Route and Klein Karoo areas, understanding these uses is crucial for compliance and sustainable water management.
Section 21 Water Uses:
- Taking Water from a Water Resource: This includes drawing water from rivers, dams, lakes, or underground sources.
- Storing Water: This applies to individuals or entities storing water in dams or reservoirs.
- Impeding or Diverting Flow in a Watercourse: Any actions that alter the natural flow of a watercourse, such as building a dam or weir, fall under this category.
- Engaging in a Controlled Activity: These activities, specified by the Minister, may impact water resources significantly.
- Discharging Waste or Water Containing Waste into a Water Resource: This includes any effluent discharge into rivers or lakes.
- Disposing of Waste in a Manner that May Detrimentally Impact a Water Resource: Proper waste disposal is crucial to prevent contamination of water resources.
- Disposing of Water Used for Industrial Purposes: This involves the disposal of water used in manufacturing or other industrial processes.
- Altering the Bed, Banks, Course, or Characteristics of a Watercourse: Any physical changes to a watercourse require a license.
- Removing, Discharging, or Disposing of Water Found Underground: This includes dewatering activities often associated with mining.
Who Needs to Apply: Anyone engaging in the above activities within the Garden Route and Klein Karoo areas must apply for a water use license. This includes farmers, industrial operators, developers, and other relevant users. Ask for advice if you are unsure.
